Quote:Justification
Analyses show that e-cigarettes contain chemicals and components which pose danger to consumers. For that reason, all NCP should be subject to control. Otherwise, products with levels of nicotine concentration just below the proposed thresholds, could reach the market without any authorisation. Not only a concentration of nicotine is relevant but a mixture of all substances is too. Consumers indicate as well, that they mainly use e-cigarettes to quit smoking, seeing it as a medicinal product, therefore they should be authorised in accordance with Directive 2001/83/EC.
Are they going to regulate Tomato's now too? WTF

Might need Doodlebug to dissect this for me lol

Quote:Nicotine-containing products as for example e-cigarettes contain toxic chemicals and tobacco-specific components suspected of being dangerous to consumers. Moreover, analyses in the field show that e-cigarette cartridges labelled as containing no nicotine in many cases do in fact contain low levels of nicotine. For that reason, all nicotine-containing products should be subject to control. Otherwise, products with levels of nicotine concentration just below the proposed thresholds, could reach the market without any authorisation. As indicated above, not only a concentration of nicotine is relevant, but also the mixture of all substances as such. Consumers indicate as well, that they mainly use e-cigarettes to quit smoking, what suggests that e-cigarettes are perceived as a medicinal product. Your Rapporteur proposes therefore, to authorise all nicotine-containing products in accordance with the Directive on the Community code relating to medicinal products for human use (2001/83/EC).
Since some markets might be more affected by the proposed Directive than others your Rapporteur is of the opinion that it is necessary to introduce a longer transitional period for tobacco products, nicotine-containing products and herbal products for smoking.

1. Member States shall prohibit cross-border distance sales of tobacco products to consumers located in the Union.

Bye bye online retailers.

The ONLY good thing I can find is they have agreed it will take longer to implement all of this.

I can but viagra online, I get emails every day asking if I want to buy from Canada. Plus just about every other prescription drug you can imagine. People buy prescription medicines omnline
Also are they going to ban farmers from using nicotine as a pesticide?
I can imagine some terrible things happening if this goes through.

Doesn't sound good. Will be expecting an email inbox full of e-liquid spam :(

This appears to be a list of ammendments to the proposed directive and it's all couched in jargon, which makes it difficult to decipher.

If I've read it correctly (if), it seems like they've removed the threshold on nicotine limits, bringing ALL nicotine content levels under the umbrella of the directive. This presumably means that the under 4mg/ml 'free pass' for ecigs has been removed. It also seems that they want to classify e-cigs as smoking cessation aids, and therefore, as medicinal products.

I would assume that this means they'd have to be medically licensed.

It's stated that e-cigs are widely viewed as smoking cessation aids, but I think they are referring to TOTAL cessation i.e. we should use e-cigs to get off the fags and then quit vaping too.

The cross border sales ban refers to 'tobacco products'. If they're going to classify e-cigs as medicinal products, then perhaps this ban won't apply to e-cigs?

If what I'm assuming in what I've written above is accurate, then I reckon we'll still be able to buy e-cigs (even at reasonable nic contents), but only medically approved brands that have been rigourously tested.

In other words, the 'done deal' that I've been banging on about might well be coming to pass.

Well, if this is what's gonna happen, they can ram their 'approved' brands where it don't shine.

I've got a couple of litres of 50mg nic base in my freezer and my last batch of mixes I dropped my nic level to 8mg/ml.

By my reckoning, I'd use 160ml of nic base per litre of finished juice.

So I've got enough nic to mix about 12.5 litres of juice.

If I can average a usage of 5mls per day, I should be ok for e-liquid for just under 7 years. After that, if I had to source nic base illegally then so be it.

I can't go into detail on this right now (sorry!) but suffice to say, there is no need to panic, but we do need to keep the pressure on.

All this stuff at this stage is merely posturing. NO final decisions have been made. We are still working on getting a sensible amendment put forward, and in any event, there is a good chance that the TPD may not survive other attacks which have nothing to do with us anyway! Many, many opposition voices being raised - from a wide variety of Member States, etc.

They will NOT be allowed to sentence us to death - so don't worry. Just keep writing those letters, and forcing the facts on them. Eventually, either they will see sense, or a Judge will tell them where to stick it. :P

Cheers,

Katherine

I was chatting with the guy behind the counter at Liberty Flights today about this.

His take is this:

They import medical grade Nic base and thinks they will be able to continue to do this.
Anyone can sell a battery.
Anyone can sell an atomiser.
Anyone can sell food flavouring.

I was quite surprised, but he said he wasnt worried at all!..........I think the idea is sell it separately?
